Privacy Policy regarding the processing of personal data

Argenta SRLS provides you with this information regarding the processing of personal data of Users who consult the website http://www.argenta.store (the “Site”) pursuant to Article 13 of EU Regulation No. 679/2016 on the protection of personal data (the “Regulation”).
This information is provided only for the Site and not for other websites that may be consulted by the User through links.
Please note that the Site uses COOKIES as further specified in the related cookie policy at the bottom of this information.
- Data Controller
The data controller of personal data is Argenta SRLS, based at viale Pasteur 49, 00144 Rome (RM), Tax Code 16219181001, PEC argentasrls@pec.it (hereinafter the “Data Controller” or the “Company” or “Argenta”).
- Purposes and legal basis for the processing of personal data, nature and consequences of the failure to provide such data
The personal data relating to the User that Argenta collects and processes through the User's access to the Site are those data that the User has freely and voluntarily provided for the purposes indicated below.
Such data include: first name, last name, date of birth, gender, residential address, shipping address, home phone number, mobile number, and personal email address (“Personal Data”).
Argenta also informs you that the IT systems and software procedures responsible for the operation of the Site acquire, during their normal operation, certain data whose transmission is implicit in the use of Internet communication protocols. These are information that is not collected to be associated with identified data subjects, but which by their very nature could, through processing and associations with data held by third parties, allow for the identification of Users. This category of data includes IP addresses or domain names of computers used by users connecting to the site, URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters related to the User's operating system and IT environment. This data is used solely to obtain anonymous statistical information on the use of the Site and to check its proper functioning.
Argenta also informs you that credit card data (card number, cardholder, expiration date, security codes), which will be requested from the User to execute the online purchase of products for sale on the Site, will be acquired by the payment service provider acting as an independent Data Controller. Such data will be acquired in encrypted format and in accordance with the security requirements of the relevant certifications. Argenta will only keep track of the last four digits of the credit card number and its expiration date, as well as log files and IP addresses used during the finalization of the purchase, in order to prevent and ascertain any fraud in online transactions.
Your Personal Data will be processed, as applicable, for the following purposes:
- registration on the Site;
- conclusion, execution, and operational management of the sales contract for goods through the Site, as well as for purposes strictly connected, related, derived, and instrumental to the sale (for example, product selection, sending orders and related acceptance, delivery and any exercise of the right of withdrawal and consequent return of goods, as well as any other fulfillment provided for in the sales conditions);
- fiscal and administrative-accounting;
- sending email communications aimed at promoting the sale of products similar to those already purchased by the User, without prejudice to the User's right to object at any time;
- subscription to the commercial Newsletter containing marketing communications, news, information, and updates on products and services, offers, discount coupons, promotions, and special events of Argenta;
- sending by postal service or via SMS, email, telemarketing, and similar - other commercial/marketing communications related to products marketed by Argenta and, in particular, offers, news, discount coupons, promotions, and special events;
- analysis of the User's preferences and consumption habits and processing of the User's personal preferences and interests through automated tools and the transmission of personalized offers via the Site;
- response to any communications sent to the Data Controller, also via the Site, or by email or telephone, to report issues and/or to submit requests (including assistance) or comments regarding the products
At the time of collecting Personal Data for the aforementioned purposes, specific information pursuant to Article 13 of the Regulation will be provided in the relevant sections of the Site, and the relevant consents for processing will be requested where required.
The provision (and the related processing) of Personal Data:
- is necessary for the purposes of paragraph 2 (i), (ii), and (iii), in order to allow the Company to follow up on the User's request for registration on the Site and to fulfill its contractual and/or legal obligations. Therefore, the failure to provide such data would result in the inability for you to navigate the reserved areas of the Site, proceed with the purchase of desired products, ensure delivery, any return of products, as well as any other fulfillment provided for in the sales conditions;
- is optional for the purposes of paragraph 2 (iv), without prejudice to the fact that the related processing does not require your prior consent, given the legitimate interest of the Data Controller in sending email communications aimed at promoting the sale of products similar to those already purchased by you on the Site. However, if you refuse the use of your Personal Data – exercising your so-called opt-out right – for the sending of such future communications, this will not affect your ability to proceed with the purchase of desired products, but will prevent you from receiving informative and/or commercial communications related to Argenta's products similar to those already purchased by you;
- is optional for the purposes of paragraphs 2 (v), (vi), and (vii) and the related processing is only permitted with prior consent. The failure to provide (and related processing) of Personal Data for these purposes will not affect your ability to proceed with the purchase of desired products, but will prevent you from receiving the commercial Newsletter, other commercial/marketing communications, possibly personalized, related to Argenta and Argenta products;
- is necessary for the purposes of paragraph 2 (viii), in order to allow the Company to respond to communications and/or requests received. Therefore, the failure to provide (and related processing) of Personal Data for this purpose would result in the inability of the Data Controller to provide responses to the communications and/or requests sent by you.
It is emphasized, therefore, that every processing of Personal Data occurs on the basis of a lawful “justification” (or legal basis) for processing. In particular, the processing of Personal Data is justified based on one or more of the following premises:
- the processing is necessary for the performance of a contract/agreement with the User or to follow up on activities requested by the User;
- the processing is based on the legitimate interest of the Data Controller;
- the processing is based on the prior explicit consent of the User.
- Processing methods and retention period
The processing of Personal Data is carried out through the operations indicated in Article 4(2) of the Regulation, namely: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, deletion, and destruction of data.
Personal Data will be processed, with the support of telematic, IT, and/or paper means, limited to the purposes outlined above and in a manner that ensures their security and confidentiality and to prevent loss, unlawful or incorrect use, and unauthorized access.
Personal Data will be processed:
- with reference to paragraph 2 (i), until you proceed to delete your Account profile from the Site;
- with reference to paragraphs 2 (ii) and (iii), for the time necessary to execute the contractual relationship and to fulfill the legal and administrative-accounting obligations of the Data Controller for a maximum period of 10 years from the termination of the relationship;
- with reference to paragraph 2 (iv), until you exercise your opt-out right in the manner provided for in the subsequent Article 8;
- with reference to paragraphs 2 (v) and (vi), for a maximum period of 24 months;
- with reference to paragraph 2 (vii), for a maximum period of 12 months;
- with reference to paragraph 2 (viii), for the time strictly necessary to achieve the purposes for which they were collected.
In any case, the statutory limitation periods set for the rights and obligations underlying the processing carried out will be respected.
It is emphasized that, in any case, your Personal Data will be processed by personnel of the Data Controller duly appointed and trained by the Data Controller itself.
- Recipients of personal data
Personal Data may be communicated, in strict relation and compatibly with the purposes outlined above, to the following categories of subjects:
- companies belonging to the Argenta Group for the purposes of paragraph 2 (ii) and, in particular, to ensure adequate support to the User on products bearing trademarks owned by other companies belonging to the Argenta Group; the failure to provide such data could result in the inability to fulfill contractual and/or legal obligations;
- third parties for any activities carried out in outsourcing on behalf of the Data Controller, including, in particular
- transport/shipping services;
- mailing services, also aimed at communicating to the User the progress of the order or sending commercial/marketing communications;
- data analysis services;
- services for the application management of the Site;
- banks and credit institutions;
- supervisory authorities.
Subjects belonging to the above categories operate independently, as independent data controllers, or as responsible parties who carry out activities in the interest of the Data Controller. The list of data processors can be requested at the following email address privacy@argenta.store
- Transfer of personal data to a third country or to an international organization
The Data Controller does not intend to transfer Personal Data to countries outside the European Union.
It remains understood that the Data Controller - should it become necessary (essentially considering the location of the servers of third parties called to perform, on behalf of the Data Controller, outsourcing services referred to in paragraph 4 of this information) - will have the right to transfer your Personal Data also outside the EU. In such case, the Data Controller assures that the transfer will take place in accordance with applicable legal provisions, subject to the adoption of standard contractual clauses as issued by the European Commission.
- Rights of the data subject
The User - as the Data Subject - can exercise, at any time, where applicable, the following rights against the Data Controller:

At any time you will also have the right to withdraw consent, where it has been given pursuant to this information. The withdrawal of consent to processing does not affect the lawfulness of the processing carried out on the basis of the consent previously given.
